IMPORTANT DEP NOTICE:
The Twin Branch #1 Dam is a regulated Dam under the jurisdiction of the Dam Safety Act (WV State Code 22-14) and the Dam Safety Rule (Legislative Rule 47CSR34). The Dam is classified as a Class "1" (High Hazard Potential) Dam. This means if the dam were to fail, the potential for the loss of human life is likely. The failure of a "dam" is not considered an "Act of God" even during a storm event. Under "Common Law", the owner of an impounding structure is responsible and liable for any damage or loss of human lives caused by the impounded water.
The Twin Branch #1 Dam was issued a Certificate of Approval in 1990, however the Certificate has been expired since 2016. Having a Certificate of Approval (COA) in good standing indicates that the dam's configuration meets or exceeds the minimum requirements of the Dam Safety Act and Rule and all compliance obligations are met. The COA is good for one year and will be renewed in subsequent years provided that the dam is being properly maintained according to the Rule (47CSR34) and all fees, inspections, Monitoring and Emergency Action Plan, and Maintenance Plan are current and up to date.
Upon completion of the sale, the new dam owner must submit a completed "Dam Ownership Transfer Form" and "Owner Contact Form" to WVDEP-Dam Safety.
Immediate measures necessary to bring the Twin Branch #1 Dam into compliance include the following:
1. The owner is required to hire a Registered Professional Engineer (RPE) to perform a visual inspection of the dam and submit a written report with photos and a certification statement. This dam is required to be inspected every other year and after a 50-year / 6-Hour or greater storm event by a RPE.
2. As a Class "1" structure, the Dam is required to have a current and active Monitoring and Emergency Action Plan (MEAP). This MEAP must be reviewed, revised and/or updated annually.
3. As a Class "1" structure, the annual registration fee is $100. The owner will be invoiced for this fee annually by the WVDEP prior to the due date.
4. The Dam will be required to be operated and maintained as a Class "1" Dam in accordance with requirements of the Dam Safety Act (State Code 22-14) and Dam Safety Rule (Legislature Rule 47CSR34).
REAL ESTATE TERMS: 20% nonrefundable down payment made day of auction (or within 24 hours for online bidders) with balance due at closing. Cash, check, & wire transfer accepted. Credit cards will not be accepted for the down payment. No financing contingencies will be entered into the contract. Any required inspections must be completed prior to bidding. Property is being sold as is, where is with no warranty written or implied.
Property will be sold free and clear of all liens. Seller is conveying surface rights only with no oil, gas, coal, mineral, or other subsurface interests conveyed unless otherwise noted. 30 days given to close. Announcements sale day take precedence over all advertisements published. 10% Buyers Premium will be added to determine final contract price. Name of purchaser on contract must be the name of the winning bidder or an entity which the winning bidder legally represents. No exceptions. Real estate sold subject to owner confirmation unless otherwise noted.
