TERMS OF SALE
1. Ten Percent (10%) nonrefundable down payment required on day of sale along with a Ten Percent (10%) Buyers Premium to be added and due on the day of sale with the balance due at closing by certified or cashier’s check, or cancellation of existing indebtedness in the discretion of the Successor Trustees. No financing contingencies and closing to take place within thirty days (30) of the day of sale;
2. Subject to any prior deeds of trust or security agreements of record;
3. Subject to any special assessments or any liens for taxes;
4. The successful bidder shall be responsible for the payment of the transfer taxes imposed by West Virginia Code § 11-22-2.
5. The above-described real estate will be sold by the undersigned Successor Trustees by auction to the highest bidder subject to the right of the undersigned Successor Trustees to reject all bids if, in their opinion, said bids are inadequate;
6. The owner of the indebtedness secured by the Deed of Trust shall have the right to bid; and
7. The above-described real estate will be sold in “AS IS” condition. The sale shall be without representation or warranty of any kind, express or implied.
8. Such other terms as may be announced at the time of sale.
CONTINUANCE OR ADJOURNMENT OF SALE
The undersigned Successor Trustees reserve the right to continue the sale or to adjourn the sale for a time or from time to time without further notice other than oral public announcement at the time and the place of sale as hereinabove set forth or at any continuance or adjournment thereof.
