ONLINE PERSONAL PROPERTY AUCTION TERMS:
Firearms Information: ONLY WV residents may pick up rifles and shotguns during the scheduled pickup times at the location of 610 Sweet Springs Lane, Summersville, WV 26651. Only the registered winning bidder may take possession of the firearm during the on-site pickup with verification of a valid Government issued photo identification. Non-WV residents must have all rifles and shotguns transferred through a Federally licensed firearms dealer. All handguns must be transferred through a Federally licensed firearms dealer in the winning bidder’s state of residence. Auction Company will provide a scheduled pickup date for rifles, shotguns, and WV residents with handguns at its licensed FFL premise located at 71 Auction Drive, Jane Lew, WV on Tuesday, January 25, 2022 from 5:00 – 6:00 PM. Any firearms not picked up during the on-site pickup or the scheduled pickup in Jane Lew, WV will be presumed to be shipped and will require and FFL on file to be processed.
Firearms Pickup by Licensed Dealers (FFL and C&R): If the winning bidder holds an firearms license (FFL or C&R FFL) and wishes to pickup eligible firearms during the on-site pickup, they may do so ONLY if their name appears on the license or with an accompanying original copy of Letter of Authorization. The person taking possession of the firearm must be the named licensee or named on an original copy of Letter of Authorization. A licensed dealer may pickup for another party if they are the named licensee or if their license is accompanied by a Letter of Authorization signed by the named licensee.
Special Note: Our Company adheres closely to all federal, state, and local laws and regulations regarding the transfer of firearms. If you are the winning bidder and later discover that you cannot take possession of the firearm, there will be no refunds given. It is the bidder’s responsibility to determine their ability to take possession of the firearm(s) in accordance with the terms of the auction and all governing laws and regulations BEFORE BIDDING. Your bid is a binding contract and we will not entertain requests for bid retraction.
Firearms Shipping Information: Auction Company will provide in house shipping for firearms and other manageable items. Firearms will be shipped via USPS Priority or UPS Ground from our FFL location at 71 Auction Drive, Jane Lew, WV to licensed FFL holder. Please allow up to 14 business days from the time Auction Co receives the receiving FFL’s license for the package to be prepared and sent. All packages will be shipped with Adult Signature Required. Insurance will be added to the package only at the bidder’s request. The winning bidder will be charged actual postage plus $15/ package for materials and handling. The card on file for the bidder will be automatically charged for the total amount due for shipping before the package is shipped. If the card on file declines, the winning bidder will be sent an electronic invoice via Auction Company credit card processing service Square for payment. Packages will not be shipped until the total amount due for the shipping/handling/materials is paid.
Other Items Shipping Information: Auction Company will provide in house shipping for most items in this auction. Some items that are oversize, overweight, or too cumbersome to be packaged and shipped will be excluded for in-house shipping (noted on the catalog). Auction Company will ship via USPS Priority or UPS Ground (depending on restrictions and the lowest quote provided by the shipping software). The winning bidder will be charged actual postage plus $15/ package for materials and handling. The card on file for the bidder will be automatically charged for the total amount due for shipping before the package is shipped. If the card on file declines, the winning bidder will be sent an electronic invoice via Auction Company credit card processing service Square for payment. Packages will not be shipped until the total amount due for the shipping/handling/materials is paid. All packages will be sent with signature required for delivery. Insurance will be added only at the buyer’s request and expense. Please allow up to 14 business days for the package to the prepared and shipped.
Bidding Errors: All bids are binding and final once an item has sold. Once bidding for a lot has closed, bids cannot be deleted or removed. Please review your bids on the review page prior to submitting the bids. Outbid notifications are sent as a courtesy only and the auctioneer, seller, licensees, agents or employees are not responsible for errors, omissions and/or timing of outbid notices. Auctioneer reserves the right to refuse off increment bids. Auction Company does not have the ability to retract, modify, or remove any bids placed during the pre-bidding of the auction.
Online Bidding Disclaimer: Auction Company utilizes third party bidding platforms (herein “bidding platform”) to facilitate the collection and recording of online bidders. By agreeing to these terms, bidders agree to hold harmless Auction Company and all Bidding Platform providers for technical errors and mistakes that may arise from connectivity issues on the part of the Auction Company and the bidder. As-Is, Where Is: All items and lots are sold on an As-Is, Where-Is and With All Faults basis without exception. Pyle Complete Auction & Realty Service does not guarantee the year of vehicle. As with vehicles, parts could have been added or subtracted throughout the years. Buyers understand that all lots and items are being offered as used and therefore have some level of wear and/or damage and are by the very nature of being "used and/or pre-owned and/or aged" are at some level of defective. The auctioneer and seller expressly and specifically disclaim, without limitation, any warranty of merchantability or fitness for a particular purpose. Removal is at the buyer's sole obligation, risk and expense. Buyer understands that any description given in the catalog or written on the lot is not guaranteed, and the buyer will rely entirely on their own inspection and/or investigations. Every item sold is sold As-Is, Where-Is. Joe R. Pyle Auctions provides condition information only as a courtesy to the bidders and is not responsible for errors in description or condition. Buyers have the opportunity to view the items in person and determine condition as well as any other factors relating to the description of the item and have the obligation to do so prior to bidding.
Forfeiture: If you do not wish to pick up or ship your items, you may forfeit them. In this regard, to forfeit your items is defined as relinquishing all ownership and claim to the items in question to the auctioneer with no expectations of reimbursement; however, you are still responsible for the invoice total. No refunds will be made if you decide to forfeit your items. If you wish to forfeit your items, please contact us on or before the removal deadline. Buyer agrees that any and/or all remaining lots left after removal deadline are considered to be forfeited, but buyer is still responsible for invoice total.
Removal of Items: Local pickup is available on the designated date and time only. The Auction Company does not offer shipping services. The Auction Company does not offer delivery services or storage services. Winning bidders must pick up items during the scheduled pickup times. If the winning bidder cannot appear at the pickup location during the scheduled pickup time, the Auction Company will prepare and package the items for shipment and ship them upon successful collection of the payment for any shipping/handling/materials charges. If the winning bidder would like to arrange alternative pickup time(s), the Auction Company may arrange (when agreeable to the seller) at an additional charge to the winning bidder of $25/hr including port-to-port travel to and from our office location.
Inspection of Items: Every item in this auction is available for bidder inspection prior to the auction ending (either during the scheduled preview session or by appointment in limited circumstances). By bidding, each bidder acknowledges and agrees that they have had a full and fair opportunity to inspect the item or lots and is relying solely on the bidder's personal inspection, whether in person, through proxy, or based on the provided photographs and opinion in determining whether to bid, in determining the amount to bid and/or maximum bid, and in submitting the bid/max bid.
Titles: Titles for any vehicles will be sent to buyer 10-15 business days following receipt of payment. Please note: any bank-held titles may take up to 30 business days for processing.
Payment: The credit card on file with your online account will be charged automatically at the conclusion of the auction. If your card on file is declined or cannot be processed for any reason, you will be contacted within 24 hours to arrange alternate payment. Your invoice must be paid in full before taking possession of the items. Payment at pickup can be accepted (check is preferred, cash in exact change is also acceptable). We can also accept wire transfers for payment.
Gold & Silver Coins: The Auction Company does not accept credit card payment for the purchase of gold and silver coins. If your invoice includes gold or silver coins, you will be required to tender payment by cash, money order, certified check, or wire transfer. Auction Company will allow credit card payment for gold and silver coins if the registered winning bidder appears in person and presents the card at the time of pickup for payment.
