TERMS OF SALE:
l. The sale is subject to confirmation by the Circuit Court of Kanawha County, West Virginia.
2. Said property will be offered by the Receiver to bring the highest bid.
3. Said property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property.
4. The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-2.
5. The Receiver reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Receiver.
6. The Receiver shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal prope1ty and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
7. A nonrefundable deposit equal to ten percent of the total purchase price is payable on the day of sale, by certified or cashier's check or other immediately available funds. The balance of the purchase price is to be paid at closing, within thirty (30) days after the date of the sale.
A 10% buyer’s premium is due and payable to Joe R. Pyle Complete Auction & Realty, LLC at the conclusion of the auction.
